The federal government has granted Quebec greater autonomy compared to other provinces, which is why its immigration programs are often handled independently. This autonomy provides Quebec with specific advantages for hiring foreign workers. In particular, the province allows for easier recruitment of foreign workers through the simplified LMIA process.

In all provinces except Quebec, a Labour Market Impact Assessment (LMIA) application must include:

  • Evidence that the employer first offered the position to Canadians and permanent residents.
  • Proof that the employer made all necessary efforts to recruit a Canadian or permanent resident for the position.

The simplified LMIA process in Quebec allows employers to submit an LMIA application without having to demonstrate that they attempted to recruit a Canadian citizen or permanent resident for the position in question.

The Simplified LMIA Process

The procedure for obtaining a simplified Labour Market Impact Assessment (LMIA) is similar to that of a standard LMIA application, with a few differences:

  • Language of the Application: All LMIA applications in Quebec must be written in French, except for positions for live-in caregivers. ESDC works with employers to mitigate the impact of this requirement if necessary.
  • Job Advertising Requirements: For a simplified LMIA, employers are not required to prove that they posted the position or attempted to recruit a Canadian citizen or permanent resident.
  • Targeted Professions: Simplified LMIA applications are limited to professions in high demand and facing labor shortages in the region of Quebec where the employer is located.
  • Submission Requirements: Simplified LMIA applications must be approved by both federal and provincial authorities. Therefore, they must be submitted to both ESDC and the Ministry of Immigration, Francisation, and Integration (MIFI).
